KELSO - The old jail has arrived back home after a 12-year stay in a backyard in Hinkley.
It now sits near the 82-year-old Kelso Depot, where a half-century ago it held a variety of miscreants during the heyday of the mid-Mojave rail stop.

"We're glad to get it back, as it adds to the authenticity of the historic landscape," said Linda Slater, a ranger with the Mojave National Preserve, which operates the depot as a museum and visitors' center.

The Union Pacific Railroad opened the stately depot in 1924. It was closed in 1985 and was destined for demolition until a group of citizens rallied to save it.

"The building has been renovated virtually as it was when the Union Pacific closed it," said Slater, who along with other park officials searched far afield for authentic artifacts, century-old photographs and original furnishings to restore its original character. MORE

$350K and no Park

Back on February 23, 2006 we wrote the article, "Talking about Illusion: The disappearing Quarter Million Dollars." At that time we had shown that the State had already gave a Prop 40 Grant of $233,000 to build the Bucky Bucklin Park. The City was requesting an additional $67,000 for the building of the same park. Today we read in this weeks Staff Report that the City is asking for an additional $50,000 in funds to build the park. That is now a total of $350,000. This is for a 1/3 of an acre park!

What is really strange is the proposed budget for the park fluctuates with every Staff Report and request for funds. The original $233,000 grant was approved in 2004 and still no Bucky Bucklin Park. According to this next request of $50,000 the budget for the project will be again $233,000. In less than a year the city has dumped $67,000 and now another $50,000 into the project but it still comes up to only $233,000. Is this some kind of mathematic formula used in government accounting? In the real world 233K+67K+50K=350K, but down at our city hall it is still just $233,000. Must be that New Math.

It would appear as much as $117,000 is misappropriated or misused or misplaced or missing. Bookkeeping error? Maybe, Maybe not. We are calling for a full independent audit of the Parks and Recreation Department.

LA Double Dipping Judges in Court

LOS ANGELES---In 1998, the state of California took over funding of all state trial court operations, including responsibility for payment of salaries and benefits to trial court judges, providing at least $100 million in taxpayer funds to county judges in the form of local judicial benefits.

Los Angeles County, which is home to one of the largest trial court systems in the United States, continues to pay "local judicial benefits" to its judges to supplement the compensation and benefits they received from the state. This "double dipping" by trial court judges costs Los Angeles County taxpayers an estimated $20 million per year.
Judicial Watch, the public interest group that fights government corruption and judicial abuse, is moving forward with its lawsuit with what it calls its judicial "double dipping" compensation scheme.

In 1997, the California State Legislature enacted a piece of legislation, known as the Lockyer Isenberg Trial Court Funding Act, which required the State of California to, "assume sole responsibility for the funding of trial court operations," including salaries and benefits beginning on July 1, 1997. In other words, from that point forward, judges were no longer considered county employees.

However, the Judicial Watch says in clear defiance of the California State Constitution and California law, Los Angeles County continued to use taxpayer funds to compensate judges in the form of "local judicial benefits."

Even though judges receive a full benefits package from the State of California, Los Angeles County also provides them $27,324 annually in cash allowances to purchase on a pre-tax basis additional health, life, disability and other benefits. Given that there are no requirements as to how the money must be spent, judges may either purchase the benefits or keep the cash allowance as taxable income.

The county dishes out an additional $4,200 annually to judges for "professional development." However, judges are reportedly allowed to pocket the money and then charge the state for these "professional development" items and services.

Such duplicate payments not only violate state law and the California State Constitution but, Judicial Watch argues, also "constitute an unlawful waste of public assets." In March, Judicial Watch provided a draft of its complaint to the Los Angeles County officials involved requesting they immediately terminate payment of "local judicial benefits." The county refused, forcing Judicial Watch to take legal action. Judicial Watch filed its lawsuit with the Superior Court for the State of California, County of Los Angeles on behalf of a county resident and taxpayer in April. However, given the fact that the lawsuit involves benefits paid to judges of that court, presenting an obvious conflict of interest, Judicial Watch is requesting that the case be transferred to another county.

To review the court filings in the case, see http://www.judicialwatch.org/lajudges.shtml 11-10-06

Each year November 11th marks the end of World War One, "The war to end all wars." On this night the 5th Marines made a night crossing of the Meuse River against stiff German resistance. Marines completed a successful reconnaissance mission against the Germans. It turned out to be the last battle of World War One. In a little more than 18 months the United States lost 320,710 men to wounds or death in combat against the Axis Powers.

We call it Veterans Day today but when many of us were children it was still called Armistice Day.

The Board of Supervisors on Tuesday appointed Assistant County Counsel Ruth E. Stringer to serve as Acting County Counsel effective today.
Ms. Stringer succeeds Dennis L. Wagner, who was appointed Interim County Counsel on May 3, 2006, following the retirement of County Counsel Ron Reitz. Mr. Wagner is returning to private practice.
Ms. Stringer joined the county in 1978 as an Employee Relations Officer and began her career in the County Counsel’s Office in 1983 as a Deputy County Counsel. From 1989 to 2003 she served as a Chief Deputy County Counsel, and was appointed Assistant County Counsel in 2003.

The county is very fortunate to have someone of Ruth Stringer’s experience and intelligence available to fulfill this very important role,” said Board of Supervisors Vice Chairman Paul Biane. “The county is constantly involved in a variety of issues that require top-notch legal advice, and we are very confident in Ruth’s ability to guide us through these challenges.”

Supervisor Biane also commended Mr. Wagner for taking time away from his private practice to serve as Interim County Counsel immediately following Mr. Reitz’s retirement. “Mr. Wagner is a seasoned litigator, and that experience served us well during the latest Colonies trial and other legal matters in which the county was involved during the past six months,” Biane said.
County Counsel reports directly to the Board of Supervisors and directs a staff of 50 attorneys who provide professional legal services to all county departments and other local governmental entities such as San Bernardino Associated Governments and the County Superintendent of Schools. County Counsel is also the chief legal adviser to the Board of Supervisors and County Administrative Officer.
Ms. Stringer holds a bachelor’s degree from the University of Illinois, and received her juris doctorate as a magna cum laude graduate of the University of La Verne.

California voters rejected a statewide proposition to restrict the government's ability to seize private property, but voters in San Bernardino County approved a scaled-down version of the measure Tuesday.

Measure O, which prohibits the county from using eminent domain to take private land and transfer it to a private developer or other entity, passed by a wide margin.

...On election day, voter turnout in the Inland Empire fell a few percentage points short of expectations, with 35% of registered voters in Riverside County casting ballots and 37% of registered voters in San Bernardino County heading to the polls.

But aside from long lines at polls Tuesday evening as voters stopped on the way home from work, and minor glitches with some voting machines, officials in Riverside and San Bernardino counties reported no major problems.

San Bernardino County spokesman David Wert said voters were allowed to cast ballots as long as they got in line by 8 p.m.

"As is the case whenever you have people show up to something, you have periods where there is no one at the polls and then suddenly 100 people will show up," Wert said.
...San Bernardino County experienced a temporary glitch on election night when the county's website said all precincts had been accounted for, when they were not. MORE

He did not buy more signs, he did not buy newspaper space, for the paper was published on November 2, 2006, he clearly spent that money on radio advertisements with Z107.7 - Gary Daigneault.

The very person that endorsed his re-election.

I have been up front and above board in this election. It speaks to those that will stop at nothing to have their agenda served.

I guess it is goodbye to the innocence of 29 Palms if this "group" prevails.

Vote to keep real people in office and to place real people into office.
Gibson: Daigneault's Sneak Attack

By Sherrie Gibson

Truly amazing, is the only way that I can describe this latest round of accusations! The radio did erroneously report that Mr. Sporkin was from Hermosa Beach and he is not. The address that was written in, “My own handwriting,” was merely a mailing address that was supplied to me by Mr. Sporkin. It did not ask for his home address, nor did it specify which business address that he needed to supply.

As I have stated on this site previously, Mr. Sporkin is licensed in Florida and he does not vote here. Further, he is not a client of mine and his listings (when they are active) are held with Libby’s Realty. This is low. To call someone a liar at the eleventh hour before the election over a business address is petty. Somewhere between the information that was supplied to me and the radio report there was a misunderstanding. That’s all. Not some grave conspiracy to deceive the voters. What’s important here is that I disclosed the individual that donated the signs; not the business address that he used.
Mr. Daigneault said that if this had been Benton or Cole then “you” would be all over them (whomever is you that he is referring to). You, Mr. Daigneault, are incorrect. I would have one, not made a big issue over a small misunderstanding and two, given Mr. Benton or Mr. Cole the benefit of doubt. All contributions were disclosed, be them monetary or non monetary. No laws were broken and certainly no lies were told. That is what the voters are concerned with.

Please don’t assume that you know me and can lump my personal character with others who may participate in the back and forth. I am a bigger person than this and I refuse to let something so small interfere with this city moving forward. What purpose does this serve? Let’s move on and let this go.
All The Best!
Sherrie Gibson

I believe that we need to end once and for all time the "Old Boys Network" that has held both the purse strings and the destiny of this town for far to long.

Lets start with Dawn Benton, Benton continues to work for and with Sunwest development, the largest development company in 29 Palms to date. This is a blatant conflict of interest. Kevin Cole's biggest supporter is Jay Corbin, who also wrote his candidates statement. This was told to me by Jay himself. Jay Corbin has done consultant work for more subdivisions than any other individual in 29 palms to date. I have a great deal of respect for Jay, he is a true professional and in my opinion one of the best at what he does.

However let me continue to state the facts.
Benton and Cole have been holding hands through the entire re-election process. They have separated themselves from Steve Spear because he doesn't serve their interest. In my opinion Benton and Cole's animosity toward Spear is clearly visible at the council meetings, probably because Spear won't hold their hands.

Good old boys club members Benton and Cole have manipulated the media through their puppet members Kurt Schauppner of the Desert Trail and Gary Daigneault of 107.7 both Directors of the Chamber of Commerce, who have chosen to make the Executive Director's boy friend Jim Harris the newest member of their club. If these three candidates are reelected or elected, we will allow them to manipulate our community well into the future. They will continue to serve their own interest rather than the interest of our city .

If elected I will work for all of the people all of the time. It's time to put an end to Special Favor.
Vote Christopher J. Curtin on Tuesday November 7th. Take back our town!

Sincerely
Christopher J.

Each candidate is allowed up to 500 words on the front page for a final argument.

By Mark Clemons

First I want to thank all the candidates for working hard to put their ideas and hearts into this year’s election. Righteous or not their effort is commendable.

The last mile on this democratic journey is left up to the voters. They will vote their minds. I ask that they apply character first and not greed before they decide.

The past city council leadership has demonstrated a lack of character. They have blatantly pushed through their own agendas and have done it with unanimous votes. This must stop!
Again I want to reiterate my message of change. It will take considerable character and courage to put through needed changes. Some of the changes needed are:

Stop the senseless allowance of only serving a 10 year council term and receiving a life long pension benefit.

Stop the senseless favoritism being orchestrated to benefit the few from the resources of all constituents.

    Stop having uncontested council meetings.

Stop faking the idea of reformulating the existing general plan. The document itself is the least of the constituents concerns. Instead let us focus on letting it be administered fairly to all. Let us all now develop our community for the next generation to enjoy and let us all allow fairness and free markets determine the benefactors.

I am proud to be a citizen of this community. With your vote I will do my very best to represent you the next four years. Thank you for taking time out of your busy life.

With Humble Respect,

Mark Clemons

Why Reelect Steve Spear

Each candidate is allowed up to 500 words on the front page for a final argument.

By Steve Spear

The choice is clear for your vote on November 7th.

You can decide to continue to stay on the road that the city is presently on or you can decide to start now and plan to stop the wave of sprawl that is coming.

I did not expect to have the thought of saving our charm and environment to be unopposed.

It has been a hard fight over the last 3 months. But that fight has been with a select few that are very vocal. Nothing new there. What also is not new is the lack of vision that is displayed by that group.
Arguments of "it won't happen", "it will take 60 years" and the such do not address the issue, they only defer it to some other time and place.

We are again faced with a choice - maintain the status quo or save the very reason of why we live here.

I have a record of making things happen and not waiting to see what happens.

In my line of work that is being proactive as compared to reactive.

By being a proactive member of the Council and working for "you" I have stepped on some toes.

Well, that is what I expect from the individuals that I vote for. I want men and women that lead and work hard for the majority of the People no matter who they may upset in the process.

That is the type of Council Member I have been and it has upset the select few because I would not do their business unless it benefited all the People all the time.

I ask for your vote so that I can continue to step on the toes that need to be stepped on. More importantly I ask for your vote so we can start to plan now for a better 29 Palms.

Thank you in advance for your support.

  Steve Spear

Making the case for Sherrie Gibson

Each candidate is allowed up to 500 words on the front page for a final argument.

By Sherrie Gibson

When asked to make the case as to why folks should vote for me on November 7th, I have to point to the fact that I have a workable solution that will get our city moving forward in the right direction. I believe in responsible growth that will add to our community and be an asset to the citizens. I have laid out a plan for the revitalization of downtown and a road map for prosperity. Further, I have pushed the other candidates to place an emphasis on retail and bringing jobs to our city.

I have taken every opportunity to express my vision of Twentynine Palms and also to listen to what others have stated as their vision. Being a city council member is not a position that I take lightly. There are problems that are inherent with the job and new challenges that lay ahead. I believe that we need to elect a balanced council. Choose members that bring their strengths to the office and those who will best serve this community. I have a diverse background and I am able to reach a wide cross section of people. My tenacious business savvy and work ethic make me a force to be reckoned with.

This election we will decide what the future of our city should be. I say we take advantage of this opportunity to bring in more retirees and promote Twentynine Palms as a destination location. Sixty Million dollars in welfare money tells me that we are heading in the wrong direction. Houses, houses, and still no retail tells me that we are heading in the wrong direction. Three incumbents, who together have not been able to outline a plan for our city’s future lets me know that somewhere there is a missing link.

Over the past eight years I have grown weary from promises of things to come. It has been frustrating to see money spent outside of our city; while knowing we have business owners who are struggling to support their families. I am asking for your vote in order to bring fresh ideas and new energy to our council. More importantly, I am asking for your vote in order to make a difference! Thank you for entrusting me to serve our city well.
Sherrie Gibson

Well, we are moving into the last week.

I will be out of town Friday through Sunday. I will be attending Headquarters Battalion's Marine Corps Ball at Primm, Nevada.

By now you have had time to have watched the second Chamber of Commerce Forum.

You too noticed the candidates that wish to continue the "March to 110,000". You also noticed the candidates that wish to fill our city with non-stake holders and build upwards of 7,000 to 9,000 low end apartments.

The offered position, by Kevin Cole, of lowering property values by eliminating an over-the-top build out number of apartments is a Red Herring.

Zoning has, and always should be, a right of the city and the People.

Just how do these other two candidates, Kevin Cole and Dawn Benton, deem that multi-family residential is more valuable than 4 per acre or commercial zoning? What crystal ball do they have that provides them that information?

The other position of "it won't happen for 50 to 60 years", that of Jim Harris, is just irresponsible.

Selling out the future to profit today? What is he talking about!

The time has come to plan now to prevent the disaster that awaits in the wings. Why the other candidates do not see this is beyond me. The candidates in Yucca Valley have seen it and they are in worse shape now than we soon will be.

I know that it is hard to be one that protects the future. But in this last week we must tell all that we know that we are on the right road to success.

Steve Spear

Please take your comments to the Candidate Forum on this one...

Everyone is an armchair chef these days. I've always thought that politics is like a big pot of savory stew. Every two years we are asked to give our opinion of its taste. Every two years a few civic minded individuals offer themselves up as the new cooks for the communal bouillabaisse.

The pot's been boiling since 1987. Some of the ingredients like the promises of jobs, a better business environment and dealing with water issues are the seasonings that everyone wants to add to the pot. Few ever bring meat to the kitchen.

The same soup has been on the stove for so long the meat and 'taders have boiled away and all we have is a bitter brew of broken promises and unfulfilled dreams.

Someone over on the forum asked the question of what is more important this year, experience or fresh ideas?

Dawn Benton to his credit answered it best at the public forum. With the staggard elections of our Council we always have experience on the Council. Again he said it best when he said two terms is enough. We agree.

The question November 7th is not if the soup can be saved by new cooks with new spoons to stir the pot but do we throw out the soup and begin anew?

If we as a community are going to compete in the 21st century yet maintain our desire to save our desert environment the recipe for success has to change.

We are looking forward to the prospect of new cooks, and fresh ideas, infusing the pot with a new banquet of success. We leave it up to you, is it time to change the recipe Twentynine Palms?
